BARRE — A former Worcester man has been charged with felony lewd and lascivious conduct with a child in an incident that occurred eight years ago.

Daniel Whitney, 21, of Missoula, Mont., pleaded not guilty to the charge via telephone in Barre criminal court Thursday.

According to court documents, the victim in the case was the daughter of Whitney family friends and went to police in March 2011 to report she had been sexually assaulted on New Year’s Eve in 2004 or 2005. The victim said that at that time she was about 11 years old.

The victim told police that Whitney, who is 4½ years older than her, had touched her inappropriately on several occasions beginning when she was 7.

In a recorded phone conversation, Whitney apologized to her for his actions.

If convicted, Whitney could serve one to five years in prison and be fined up to $3,000.
